The practical significance of the banking law is immense.

The so-called private banking law consists of a number of other provisions from various legal matters, but only securities and the stock exchange law, monetary law, questions on consumer protection and banking supervision law are referred to here.

A unified banking law does not yet exist. The relevant provisions can be found scattered in the Civil Code, the Commercial Code, Stock Exchange Act and the German Banking Act, partly in supplementary laws.

In connection with the cases of erroneous negligent advice, large scale investment fraud, trust transaction and “junk real estate cases” also present in the media, it is clear that sound legal advice is important. Private investment intermediaries and banks themselves often have a vital interest in commissions and interest and as a result may shield to a large extent possible dangers.

Should such a home be financed or larger sums invested, the entire existence is often at stake.
